General charitable purpose alternative.

I direct and authorize my trustees, or the survivor of them ("trustees"), to separate and set aside the remainder of my intangible personal property not included in "Fund A" and "Fund B" provided for above, (and my trustees shall be the sole judge of the propriety, justice and equality of such separation, without the assent or approval of any court), and join therewith: all surplus of the income of the _________[description] real estate included in the residue of my estate after paying the charges and expenses incident to the maintenance of my homestead estate provided for above; all such real estate after the final and permanent termination of the authority and right of granting permission to occupy my homestead estate as heretofore provided; my homestead estate and all the tangible personal property owned by me and wherever located, not specifically bequeathed herein; and to designate such property as "Fund C." Trustees are directed and authorized to hold "Fund C" separately, to invest and reinvest and keep it invested, to collect the rents, income, dividends and profits arising from it and, after payment of the rents, income, dividends and profits all taxes and assessments that may be levied on such fund and all charges and expenses incident to such fund and to the management of it, including a reasonable compensation to my trustees, for their services as trustees not only of "Fund C" but also their services as trustees of all the trusts created in this, my last will and testament, to pay over semiannually on the judgment of my trustees, to apply for the support, maintenance and general purposes thereof or for the purchase of books written in either the Spanish or English language or both therefor, forever the net amount of the rents, income, dividends and profits arising from "Fund C" to such free public library or libraries now existing or that may be hereafter established in the city of _________, state of _________, as my trustees may determine and select. If they shall select more than one library as a beneficiary under "Fund C," my trustees are hereby authorized to determine the proportions in which such net income, rent, dividends and profits shall be divided and applied among such libraries, and they may vary the proportions from time to time (my trustees being the sole judge of the propriety of such allocations without the assent or approval of any court). As I am making this donation in memoriam of my father, the late _________, it is my wish that in some way his name may be connected and associated publicly and permanently with this donation, and I direct my trustees to see that my wish is accomplished, and if, at any time, there shall be no free public library operating and functioning in the city of _________ in a way satisfactory to my trustees (and my trustees shall be the sole judge of that issue, without the assent or approval of any court), then to pay over to or to apply the net amount of the rents, income, dividends and profits of "Fund C" in the possession of my trustees or the survivor of them, on such dates and at the times, to such other institution or institutions as may be operating and functioning in the city of _________ for charitable purposes such as a hospital or other institution providing care and treatment for poor and worthy persons, as my trustees may determine (and my trustees shall be the sole judge of such selection and determination of such beneficiary or beneficiaries without the assent or approval of any court), and I direct my trustees to see that the name of my father, _________, continue to be associated with such donation throughout.
