Neighborhood shopping district.

SECTION ONE.

PURPOSE

Neighborhood shopping districts are designed for the convenience shopping and servicing of persons residing in adjacent residential areas, and to permit primarily such uses as are necessary to satisfy those basic shopping and service needs that occur frequently and so require retail and service facilities in relative proximity to places of residence.

SECTION TWO.

USES PERMITTED IN NEIGHBORHOOD SHOPPING DISTRICTS

In a neighborhood shopping district, no building or land shall be used and no building shall be erected that is arranged, intended or designed for any use other than those specified in this section, as follows:

2.1. Any use permitted in any residential district as set forth in _________[cite applicable section(s) of zoning code or ordinance], except _________[mobile home parks or trailer house communities].

2.2. Any use permitted in a restricted office district as set forth in _________[cite applicable section(s) of zoning code or ordinance].

2.3. Banks, federal savings banks, savings and loan associations, personal credit institutions, and other licensed financial institutions of similar type.

2.4. Personal service establishments as follows:

(a). Barber shops, beauty parlors and hair-care salons.

(b). Shoe repairing and shoe shining, provided that machinery shall be limited to _________[five horsepower].

(c). Physical culture establishments, provided that the total floor area exclusive of locker, shower and storage space shall not exceed _________[number] square feet.

(d). Dry cleaning and laundry pickup stations for work to be done elsewhere.

(e). Coin-operated laundries and dry cleaning, and retail laundries not using a high-pressure boiler exceeding _________[ten boiler horsepower] or washers exceeding _________[number] pounds capacity.

(f). Tailor, seamstress, pressing and cleaning shops having not more than _________[two pressing machines].

(g). Photographic studios.

(h). Funeral homes, provided that the principal and accessory structures shall conform to the area regulations for residential structures of the area district and for every new or enlarged portion of a funeral home, off-street parking shall be provided in the ratio of one parking space for each _________[number] square feet of floor area used for a chapel, parlor or room used for funeral services, but not less than four spaces for each establishment. Parking, other than in structures, shall conform to the provisions of _________[cite applicable section(s) of zoning code or ordinance or other legislation].

2.5. The following retail stores or shops selling new merchandise in a building, but not including the repair of internal combustion engines or the rental of trucks, vans or trailers:

(a). Dry goods, notions or novelties.

(b). Flowers.

(c). Gifts, books, music or stationery.

(d). Hardware, household furnishings or appliances.

(e). Jewelry.

(f). Sporting goods and/or luggage.

(g). Wearing apparel, including shoes.

(h). Camera and photographic supplies.

(i). Hobby, toy and game shops.

(j). Bicycles.

(k). Art supplies, pictures and picture framing supplies and services.

(l). Newspapers and magazines.

(m). Tobacco products and associated supplies.

(n). Drugstores and pharmacies.

(o). Videocassette tapes, laser discs and related goods, including rental of such merchandise.

(p). Sound recordings in all forms of reproduction.

2.6. Food stores for retail sales of:

(a). Groceries.

(b). Meats, poultry and fish.

(c). Fruits and vegetables.

(d). Candy, nuts and confections.

(e). Dairy products.

(f). Baked goods, including baking for sale at retail.

(g). Other foods, including, but not limited to, health foods and vitamins.

2.7. Restaurants and other eating and drinking places in which no alcoholic beverages other than wine and beer are sold or served on the premises, provided that establishments generally known as "drive-ins," where foods or beverages are consumed on the premises in motor vehicles, shall not be permitted. However, drive-through fast food establishments shall be permitted, provided foods and beverages purchased from such establishments are not consumed on the premises in motor vehicles.

2.8. Off-street parking as regulated in _________[cite applicable section(s) of zoning ordinance or code or other legislation] and off-street parking in a structure as regulated in this subsection. Parking in a structure shall be permitted subject to the following requirements and conditions:

(a). The setback and side yards required in _________[cite applicable section(s) of zoning ordinance or code or other legislation] shall be provided and maintained on the premises as minimum open spaces.

(b). Such off-street parking building or structure shall be limited to off-street parking only.

(c). No outdoor advertising shall be placed on the premises other than is provided for in _________[cite applicable section(s) of zoning ordinance or code or other legislation] concerning identification of the facility.

2.9. Signs of the following types:

(a). Identification signs.

(b). Directional signs.

(c). Signs advertising products or services available on the premises on which they are displayed.

SECTION THREE.

SPECIAL EXCEPTIONS

In a neighborhood shopping district, no land shall be used and no building or occupancy permit or any license as required by the _________[city] Municipal Code shall be issued for any of the following specified uses until the Board of Appeals, after receiving a report thereon from the City Planning Commission and after due notice to the parties in interest and public hearing, has determined that the special exception for the use is consistent with the spirit and purpose and intent of this ordinance, will not substantially and permanently injure the appropriate use of neighboring property and will serve the public convenience and welfare.

3.1. Skilled-care nursing homes, provided that the ground floor frontage of the building within which the nursing home is located is suitably developed for compatible business uses, necessary nursing home pedestrian and vehicular entry-exit points excepted.

3.2. Dry cleaning establishments operated on a retail basis directly with the ultimate consumer on the premises, subject to compliance with the following regulations:

(a). Automatic operation in fully closed systems approved by _________[specify appropriate officials, such as: the Inspector of Buildings and the Commissioner of Health] in which cleaning, drying, extracting and deodorizing processes are completed entirely within one unit, provided that where the cleaning, drying, extracting and deodorizing operations require the manual transfer of materials from one machine or machines to another machine or machines, such manual transfer shall be carried out only by competent, trained machine operators.

(b). The total rated dry cleaning capacity of all machines shall not exceed _________[number] pounds of items to be cleaned.

(c). Use of a nonflammable solvent approved by _________[specify appropriate officials, such as: the Inspector of Buildings and the Commissioner of Health].

(d). Located in a structure not containing dwelling accommodations.

SECTION FOUR.

YARD REQUIREMENTS

Whenever a premises in a neighborhood shopping district abuts on a property in a residential district, a side and/or rear yard of not less than _________[number] feet in width shall be provided.
