Oil
and gas storage.
Section 1. Petroleum products storage, as a
principal use, for wholesale or retail distribution, of more than 100,000
gallons aggregate storage capacity, subject to the Fire Prevention Code of the
National Board of Fire Underwriters, may be permitted as a conditional use in
industrially zoned districts, subject to the following requirements:
(a). All storage tanks and loading facilities shall
be located at least _________[number] feet from any exterior property
line.
(b). All storage tanks and loading facilities shall
be located at least _________[number] feet from any exterior property
line bordering a residentially zoned district.
Section 2. As a prerequisite to approval of an
application for the conditional use specified in Section 1, above, the
_________[specify legislative body, such as: Town Council] must find
that:
(a) The use of the proposed site for petroleum storage will not
endanger the safety of residential or other properties in the area; and
(b) Vehicular access to the storage facility will be provided from
major thoroughfares and will not require the use of minor residential access
streets for access to the site.
Section 3. The underground storage of not more than
100,000 gallons of petroleum, accessory to permitted motor vehicle service
stations, is permitted in _________[specify zoning districts, such as:
neighborhood business, general business, light industrial and general
industrial districts] subject to regulations pertaining to accessory uses
in those districts and also to the Fire Prevention Code of the National Board
of Fire Underwriters.
